Carrie offered to sell a set of legal encyclopedias to Antonio for $300.00. Antonio said that he
would think about her offer and let her know his decision the next day. Norvel, who overheard
the conversation between Carrie and Antonio, said to Carrie, “I accept your offer..” Carrie gave
Norvel the books.
The next day, Antonio, who had no idea that Carrie had already sold the books to Norvel, told
Carrie that he accepted her offer.
Please answer the following questions:
1. Is Carrie obligated to sell the encyclopedias to Norvel? Why or why not?
2. Has Carrie breached a valid contract with Antonio? Explain.

Case Scenario #2
Express versus Implied Contracts. Suppose that a local businessperson, McDougal, is a good
friend of Krunch, the owner of a local candy store. Every day on his lunch hour McDougal goes
into Krunch’s candy store and spends about five minutes looking at the candy. After examining
Krunch’s candy and talking with Krunch, McDougal usually buys one or two candy bars. One
afternoon, McDougal goes into Krunch’s candy shop, looks at the candy, and picks up a $1
candy bar. Seeing that Krunch is very busy, he catches Krunch’s eye, waves the candy bar at
Krunch without saying a word, and walks out.
Is there a contract? If so, classify it.
